      CCW/Open Carry In A Vehicle....

      I have an AZ CCW, but still have questions concerning having a gun in a vehicle.

      Can a pistol be carried in a vehicle loaded, holstered and placed between the seats next to the
      hand brake or in a map pocket on the door or the center console IF ONLY THE BUTT of the gun is
      showing?

      Does the gun have to be 100% out of view if you carry concealed in a vehicle or 100% visable if
      carried openly? Is there any in between as I described above?

      I don't know about AZ but in FL it has to be concealed. You could put a hat or newspaper over it and it would be legal. As long as anybody walking by can't see it your good to go in FL.

      I'm not a lawyer or a cop, but as I understand it, it can be in plain view or concealed.

      During the "Si Se Puede" marches of the illegal immigrants, I had an M4gery in the passenger side footwell.

      If you have a CCW it can be visible or concealed. You can not however hold it in your hand where it is visible to other drivers as you go down the freeway. They call that brandishing and it will cause problems for you.

      If you do not have a CCW it must be in a glove box/console, visible or in a holster. A holster is considered adequate containment.

      You can have it on your belt in Open Carry style even though it is not clearly visible while sitting in the vehicle as long as it is visible when out of the vehicle standing up.

      I listed most of this for others to see how nice it is to be in Arizona. If you are going to carry in Arizona though read the laws for yourself cause info on the Internet is only as good as what you paid for it. That is my set of weasel words and I'm sticking to them.

      Thanks for the replies so far.

      I have an AZ CCW and I've read the AZ statutes in an article that even cites case law on the issue
      of what is/is not allowed with concealed and open carry in a vehicle. But then I'm not a lawyer and
      I'm only trying to make some sense of the mumbo jumbo.

      It a nutshell, from what I make of it... concealed means just that, 100% out of view and a CCW
      permit is required. Open carry means it must be in plain view and visable to anyone looking into
      the vehicle. If you have a CCW permit, you can carry either way

      My question is define plain view. Is the butt end of a gun, sticking up between the seats, or out
      of a map pocket, considered concealed, in plain view or neither?
      I'm thinking it doesn't meet the
      criteria of either mode of carry....

      A. A person commits misconduct involving weapons by knowingly:
      1. Carrying a deadly weapon without a permit pursuant to section 13-3112 except a pocket knife concealed on his person; or
      2. Carrying a deadly weapon without a permit pursuant to section 13-3112 concealed within immediate control of any person in or on a means of transportation; or

      F. Subsection A, paragraph 1 of this section shall not apply to a weapon or weapons carried in a belt holster which holster is wholly or partially visible, or carried in a scabbard or case designed for carrying weapons which scabbard or case is wholly or partially visible or carried in luggage. Subsection A, paragraph 2 of this section shall not apply to a weapon or weapons carried in a case, holster, scabbard, pack or luggage that is carried within a means of transportation or within a storage compartment, map pocket, trunk or glove compartment of a means of transportation.

      I don't know how to clarify it any better.

      If it is in a holster it can be anywhere within your vehicle whether you have a CCW or not.
